Herrgott, das ist wie bei Heise, eine Überschrift auf Blödzeitungsniveau. Wenn ihr schon die Überschrift von eff übernehmt, dann lasst das Wörtchen "Promo" bitte drin.
Dann möchte ich doch mal aus der Anklage zitieren:
" This license is printed on the CD itself and/or on its packaging and has included the
10 following language:
11 “This CD is the property of the record company and is
12 licensed to the intended recipient for personal use only.
13 Acceptance of this CD shall constitute an agreement to
14 comply with the terms of the license. Resale or transfer of
15 possession is not allowed and may be punishable under

18 clearly been that promotional CDs are provided only for limited purposes, are

27 would be logistically difficult, expensive, time consuming, and unnecessary), UMG
28 polices the unauthorized sales of its promotional CDs over eBay by locating
auctions on eBay that offer UMG’s promotional CDs for sale and requesting that
2 eBay remove the auctions pursuant to a procedure set up and implemented by eBay
3 known as the Verified Rights Owner (“VeRO”) program. SUF 11. Additionally, if
4 UMG determines that a recipient of its promotional CDs has been offering them for
5 sale, it attempts to delete that individual from the lists of persons to whom
6 promotional CDs are provided. SUF 12.

Es geht also ersteinmal darum, das Universal ein Problem damit hat, wenn Werbematerial, dass sie auf eigene Rechnung verschicken, plötzlich irgendwo im Verkauf auftaucht. Ich kann die Argumentation, dass eigentlich kein Besitzwechsel stattgefunden hat, schon nachvollziehen. Und wenn ich den Artikel von eff richtig verstehe, hat der saubere Herr ja auch nicht die ihm zugeschickten Tonträger verkauft sondern sie in Secondhand-Plattenläden (wo sie eigentlich auch nicht sein dürften) zusammengekauft und dann auf Ebay angeboten.
Man muss sich klar machen, dass es hier _auch_ um Promo-CDs geht, die vor dem Verkaufsstart an Radios etc. verschickt werden. Es ist doch verständlich, dass die Inhalteindustrie da gern den Daumen drauf hält.
Übrigens geht die Klageschrift damit weiter, dass dieser Herr Augusto das Weiterverkaufen entsprechender CDs zu seinem Lebensunterhalt gemacht hat, damit gegen die Ebay-Richtlinien verstößt und wohl schon in zwei weiteren Fällen Ärger wegen seines Verhaltens bekommen hat.
Vor weiterem Einprügeln auf die pöse Musikindustrie (dem ich sonst immer gern zustimmen würde), einfach mal

Und wer tatsächlich darunter leidet, dass er keinen Platz für Werbe-CDs hat ;-), der möge sie doch vernichten, das ist dann wegwerfen ohne Besitzwechsel.
